Terms of service.

These Terms are a binding agreement between Foto Master Ltd ("PixelDepot", "we", "us") and the person or organization that uses the site or, when it opens, the API. They have not been reviewed by counsel, and the review under way may change them.

Agreement and operator

PixelDepot is operated by Foto Master Ltd, Ilan Ramon 5, Ness Ziona, Israel, doing business as PixelDepot. By using the site, joining the beta list, or later calling the API, you agree to these Terms. If you are agreeing on behalf of a company, you confirm you may bind it.

What exists today

PixelDepot finds open-source image AI projects, reviews their licenses for commercial use, benchmarks and improves them, and hosts them behind one API. Today that means a published catalog, a face model in training, and a beta list. No service is serving traffic, no API keys are being issued, and no account or dashboard exists.

Anything described as beta, early access or in development is provided as is, may change or be withdrawn, and carries no availability commitment.

Eligibility and accounts

You must be able to form a binding contract, and you must not be barred from receiving the service under applicable law or sanctions. When accounts exist, you are responsible for the credentials issued to you and for everything done with them. API keys are secrets: treat a leaked key as compromised and revoke it.

Acceptable use

You may not use PixelDepot, and may not permit anyone else to use it, for:

  • Discrimination or segregation of any person or group.
  • Decisions about employment, housing, credit, insurance, education or eligibility for a benefit.
  • Law enforcement, surveillance, or identifying or tracking a person.
  • Identity verification.
  • Differential pricing or differential access based on protected characteristics.
  • Advertising exclusion or demographic profiling.
  • Processing anyone without the notice and consent their jurisdiction requires.
  • Non-consensual sexual content, deceptive impersonation, or unauthorized use of a public figure's likeness.

Your responsibilities to the people in the images

You send us images of people. That places obligations on you that we cannot discharge for you, and they are contractual, not advisory:

  • Notice and consent, before capture, in the form your jurisdiction requires. Illinois BIPA and Texas CUBI are the strictest we see and are your responsibility as the operator of the booth, app or venue.
  • A warranty that any candidate templates and target faces you supply are licensed and authorized for the use you are making of them.
  • A manual override wherever an automatic recommendation is shown, so a participant can accept it, choose differently, or continue without it.
  • No production processing of children. Performance on minors is unvalidated and this is prohibited in v1.
  • No processing of incidental bystanders who did not consent.

Your images and your data

Your images and the results computed from them are yours. You grant us only the permission needed to process a request and return a response.

Runtime images are never stored. They are held in memory for the request, deleted as soon as the response is returned, and never held longer than 60 seconds from receipt. They never enter object storage, logs, analytics, crash dumps or backups. Transient facial-geometry representations are computed in memory during a request and never written to disk or kept between requests.

No customer image is used to train or fine-tune a model without a separate, explicit written agreement. Silence is not consent, and continued use of the service is not consent.

What the attribute outputs are, and are not

Estimated age, perceived gender presentation and apparent ancestry are visual classifications of an image, with a calibrated confidence and the ability to return uncertain. They are never a statement about a person's actual race, citizenship, culture or self-identified ethnicity, never proof of identity, and never a basis for a decision listed under Acceptable use.

Apparent-attribute features are unavailable for EU processing. EU AI Act Article 5(1)(g) prohibits biometric categorization used to deduce or infer race, and it applies to a system placed on the EU market or whose output is used in the EU wherever the servers sit. This is enforced as an entitlement on your organization and keys, not by IP geography.

Face Analyze creates no enrollment record and stores no face embedding.

Service changes, suspension and termination

We may change, add or withdraw a service. A model can be withdrawn if its license position changes, which is the point of the four-gate review; responses name the model version and weight digest so you can see exactly what changed.

We may suspend or terminate access for a breach of these Terms, for suspected misuse, or where the law requires it, and we retain the right to audit for suspected misuse. Where it is safe and lawful to do so, we will tell you first.

You may stop using the service at any time.

Fees, billing and merchant of record

No charges are being collected today. Paddle checkout is not active yet.

When paid plans open, they are sold and processed by Paddle.com Market Limited, our merchant of record and authorized reseller, not by Foto Master Ltd directly. Your purchase is with Paddle, and you also agree to the Paddle Buyer Terms. Paddle processes payment, calculates and collects applicable sales tax and VAT, and handles order support, cancellations and refunds.

Unless stated otherwise at checkout: subscriptions are billed in advance and renew automatically until cancelled; fees are exclusive of tax; you authorize recurring charges through Paddle until you cancel; and we may change prices or plan limits on prospective notice, effective at your next renewal.

Pricing shown on this site is marked provisional and finalizes at general availability. It is not an offer.

Intellectual property and feedback

We own the PixelDepot service, site, marks and documentation. The underlying open-source models carry their own licenses, which is what the four-gate review exists to establish, and nothing here grants you rights in them beyond calling the API.

If you send us feedback, we may use it without obligation to you. We will not identify you as its source without asking.

Third-party services

The site and service run on Vercel and Supabase, send mail through Resend, and will take payment through Paddle. Each processes data on our instructions as our provider. Their failures are not something we can promise away, and their own terms apply to them.

Confidentiality

Each of us may learn non-public information from the other. Both of us will use it only for the purposes of these Terms and protect it with at least reasonable care. This does not cover information that is public, already known, independently developed, or required to be disclosed by law.

Privacy

The privacy notice on this site describes what the beta form collects and what happens to it. It is part of these Terms.

Disclaimers

The service is provided as is and as available, without warranties of any kind to the extent the law allows. We do not warrant that a model is accurate for your images, your lighting, your venue or your population, and you are responsible for evaluating it before you rely on it.

We review licenses carefully and publish what we find. That is a diligence process, not a legal guarantee. Nothing on this site or in these Terms is legal advice.

Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the amounts you paid us for the service in the three months before the claim arose. While nothing has been charged, that amount is zero.

Nothing here limits liability that cannot be limited by law, including for fraud or willful misconduct.

Indemnification

You will defend and indemnify us against claims arising from your use of the service, your content, or your failure to obtain the notice and consent your jurisdiction requires from the people in your images, to the extent such an indemnity is enforceable where you are.

This split is deliberate, and it is not total. You are responsible for your implementation and your misuse. We remain responsible for our product design, the purposes we permit, our technical controls, our data processing, and our response to misuse we know about.

Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules, and the parties submit to the exclusive jurisdiction of the competent courts of Tel Aviv-Jaffa, Israel, except that either party may seek injunctive relief in any court of competent jurisdiction, and except where mandatory consumer law in your country of residence provides otherwise.

Before filing anything, write to us and give us a fair chance to fix it.

Changes to these Terms

These Terms are versioned in the same repository as the site, so every change is a dated, reviewable commit. If a change materially reduces your rights and we hold your email address, we will tell you before it takes effect.
